Reinstatement Declaration

According to the Digital Millennium Copyright Act (DMCA), we are legally liable for infringing content being stored on our servers. As outlined in our Terms of Service, you are liable for the content that your customers post as well. As long as the content is removed in a timely manner, there are no negative consequences as outlined in the Safe Harbor clause of the DMCA.

Illegal content such as Doxxing, Trademark Infringement, Defamation, Libel, or other content that could make InMotion Hosting legally liable must be removed from our servers upon notification of its presence.  Unlike Copyright Infringement, any content of this nature is not protected by Safe Harbor protections.  Posting such content can lead to the site in question being suspended without prior notice.

We require the Reinstatement Declaration as an acknowledgment that you understand that use of materials in violation of our Terms of Service and/or Acceptable Use Policy is not something we allow, even if the material is posted by one of your customers, and that you acknowledge that you have been advised as such and will work to not have the issue occur again.

The form below needs to be downloaded, completed, signed, and returned to the InMotion Hosting Legal Team at [email protected] prior to the infringement case being closed. Failure to return the form can result in the suspension of your services.
