InMotion Hosting, Inc. (“Company”) reserves the right to determine, in its sole discretion, the validity of any claim and any submission is subject to such rights.
Company’s products, services, websites, applications and/or tools permit customers to host and make content available over the Internet. Although Company does not affirmatively screen any content and does not tolerate infringing material or certain conduct on its equipment, it may, in its sole discretion and without any legal obligation to do so, remove the content and/or limit access to the content.
It is important to note that Company is not in the business to determine what content, of any sort, is “good” or “bad” or whether it is “legal” or “illegal.” A judge or jury may ultimately make that decision. Rather, we are simply in the web-hosting business. We do not know of alleged abuse or any other conduct on a particular customer website until it is brought to our attention.
If you believe certain conduct by a Company customer has violated your legal rights, please submit a complaint in writing with the following information:
- A physical or electronic signature of the individual filing the complaint.
- Evidence that the party posting the alleged violating material is our customer.
- The location of the alleged violating material.
- The name, address and telephone number of the person filing the complaint.
- The section of our Universal Terms of Service that the website is violating.
- Detailed description of the alleged violating material.
- A good faith statement advising you to agree to our Privacy Policy.
Each complaining party must submit a separate claim for each claim of infringement. Please provide all of the requested information, signed under penalty of perjury. Company cannot and will not act on this matter until all of the requested information is provided.
Please be advised that any complaint submitted may be forwarded to third parties, including the customer complained of, for purposes of validating its contents.
Company cannot provide legal advice, and a complainant is encouraged to seek legal counsel if the complainant is not able to resolve any issues with a Company customer.
