Web Design Services Terms of Service

  1. Subject to Universal Terms of Service: The following WEB DESIGN SERVICES TERMS OF SERVICE (“Web Design ToS”) supplement and are subject to InMotion Hosting, Inc.’s (“Company”) Universal Terms of Service (“UToS”), which are incorporated herein by this reference. Capitalized terms used and not otherwise defined herein shall have the meanings set forth in the UToS. In the event of a conflict between these Web Design ToS and the UToS, these Web Design ToS shall control.
  1. Product: Company offers Customers fee-based web design services in which Customers may retain a web designer, as selected by Company, to assist Customer to design and code a Customer website on a WordPress platform (“Web Design Product”). Company offers two Web Design Product design solutions: Content Management System (“CMS”) and E-Commerce (“eCom”) packages (collectively, “Web Design Packages”).
    1. CMA Packages:
      1. All CMS Product packages include (“Standard CMS Package”):
        1. Coming Soon Page;
        2. Home Page Image Rotator (up to 5 images);
        3. Educational Video Tutorial;
        4. Standard Contact Form (up to 10 fields); and
        5. Image Gallery (up to 10 images).
      2. CMS Silver Package includes:
        1. Standard CMS Package;
        2. Number of pages – up to 7; and
        3. Stock photos/icons – 4 total
      3. CMS Gold Package includes:
        1. Standard CMS Package;
        2. Number of pages – up to 14; and
        3. Stock photos/icons – 8 total.
    2. eCom Packages:
      1. All eCom Product packages include (“Standard eCom Package”):
        1. Coming Soon Page;
        2. Home Page Image Rotator (up to 5 images);
        3. Educational Video Tutorial;
        4. Standard Contact Form (up to 10 fields);
        5. Easy Product Import;
        6. Easy Product Dashboard; and
        7. Image Gallery (up to 10 images).
      2. eCom Silver Package includes:
        1. Standard eCom Package;
        2. SKU’s – up to 25;
        3. Categories – up to 3;
        4. Static pages – 4; and
        5. Stock photos/icons – 4 total.
      3. eCom Gold Package includes:
        1. Standard eCom Package;
        2. SKU’s – up to 50;
        3. Categories – up to 5;
        4. Static pages – 8; and
        5. Stock photos/icons – 8 total.
  1. Fees and Quotes: After Customer selects a Web Design Package, Company will present Customer with a scope of work (“SOW”), which shall list the proposed work and fee for such work (“Web Design Fee”).
  1. Cancellation and Non-Refundable Product: Any Web Design Package can be canceled by Customer, in writing, prior to the first telephone interview call between Customer and Company’s web design advisor. After the initial call, Customer acknowledges and agrees the Web Design Package Fee is non-refundable, and these Web Design ToS are non-cancellable. Company reserves the right to terminate its services at any point, for any reason, provided Company refunds Customer for services not yet rendered.
  1. Customer Responsibilities: Once Company begins any work on Customer’s website, Customer is responsible for timely communication with Company’s web design advisor(s). In the event specific plugins and/or purchases are required to satisfy Customer’s needs which extend outside of those package items listed above, Customer must make such purchases separately. In the event provisioning of any plugins or scope of work extends outside of those package items listed above, Customer is subject to billing at Company’s then current hourly rates.
  1. Maintenance Plans: After Customer’s website is launched, Customer can purchase an optional recurring or one-time maintenance plan at a discounted fee. Customers that do not opt for a maintenance plan will be billed at Company’s then current hourly rates.
  1. Website Updates: Once Customer’s website is launched, Customer will be solely responsible for any updates to Customer’s website. If Customer purchases a maintenance plan, Customer may request changes to Customer’s website via Customer’s ticket system via direct email at [email protected]. Maintenance plans tickets are answered in the order received and typically completed within 5-10 business days.
