INMOTION HOSTING, INC.WEB DESIGN AND MAINTENANCE SERVICESTERMS OF SERVICELast Updated: December 10, 2025Subject to Universal Terms of Service: The following Professional WordPress Services TERMS OF SERVICE (“Professional Services ToS”) supplement and are subject to InMotion Hosting, Inc.’s (“Company”) Universal Terms of Service (“UToS”), which are incorporated herein by this reference. Capitalized terms used and not otherwise defined herein shall have the meanings set forth in the UToS. In the event of a conflict between these Professional Services ToS and the UToS, these Professional Services ToS shall control.Products. To the extent applicable to an Order, Company offers Customers the products and services located on the following pages (collectively, “Professional Services”):Custom Web Design: Startup Site, Professional Site, Signature Site.Site Rebuild: Rebuild Starter, Rebuild Pro.QuickSite: QuickSite Starter, QuickSite Plus, QuickSite Pro.Site Maintenance (Website Care): InMotion Care, InMotion Care Plus, InMotion Care Pro.Site Optimization: Website Optimization, Comprehensive Optimization.Hacked Site Repair: Standard, Priority.Search Engine Optimization: SEO Foundations Essential, SEO Foundations Pro, and SEO Addons.Sign-up, Fees and Auto-Renewal. To implement the Professional Services, Customer must sign up and pay, at the then-current fee (“Professional Service Fee”), for the applicable Professional Service on the Website(s) or within the Customer Account (i.e., via Company’s account management panel (“AMP”)). Any Professional Service Fee will automatically renew upon expiration of the then-current term for a renewal period equal in time to the most recent service period unless specified by Customer in AMP. See UToS for more information on auto-renewals. Company reserves the right to change the Professional Service Fee at any time, in its sole discretion, and such changes shall either be posted online at the Website(s) and be effective immediately without need for further notice to Customer, or notice shall be provided to Customer via email or in AMP. If Customer purchased or obtained the Professional Services for a period before a pricing change, then price changes and fees shall be effective when the applicable Professional Service Fee automatically renews.Cancellation Policy. Some Professional Services may be offered as “bundles” (e.g., one year of Web Hosting included with the purchase of a Custom Website Design plan). If the original Product or service is canceled, all bundled services will also be canceled at Company’s sole discretion. Any refund eligibility shall be determined by Company in its sole discretion, and if granted, such refund will be prorated and adjusted based on Company’s determination of the utilization of any bundled Product or services. Recurring Product or services may be canceled by providing Company with written notice via email to billing@inmotionhosting.com at least fifteen (15) calendar days prior to the end of the then current Product or service term. Failure to provide notice will result in an automatic renewal for an additional term until canceled.Promotional Rates. Company may offer promotional rates or special offers, the terms of which may or may not be more favorable than the terms and conditions for the Professional Services a Customer has previously paid for. Any such promotions or modifications shall not affect a Customer’s obligations under these Professional Services ToS. Promotional fees may be subject to additional terms and conditions which, to the extent they conflict with the terms of these Professional Services ToS, shall govern. Promotional fees and special offers may not be combined with other Products or services.Refunds: Customer acknowledges and understands that Professional Service Fees are unique and personalized to each Customer. Customer also acknowledges and understands that Company’s work begins upon sign up and as such, no refund will be given once Professional Services have begun by Company.Scope of Support and Restrictions.InMotion Hosting’s Website Maintenance Plans are designed to provide routine updates and support for eligible WordPress websites. The scope of included services, exclusions, and specific conditions are outlined below.Included Services. Maintenance plan services include the following:Content updates such as text edits and image replacementsMinor layout or design adjustmentsInstallation of basic, non-premium pluginsExcluded Services. The following services are not included in standard maintenance plans:Theme customization or plugin customizationContent creationDevelopment of new functionalities or advanced featuresAdvanced development work falls outside the scope of standard maintenance plans and will require a separate scope of work or a custom quote.If your plan includes on-demand development hours, they must be used within the same billing month and do not roll over to future months.Complex Website Support. For websites with complex technical requirements, our team will review server configurations and provide a breakdown of what is covered under the plan. Any services or needs falling outside of standard coverage will be identified, and a custom maintenance plan may be created if necessary.Outdated Software and Website Health. Outdated website software, themes, or plugins may result in performance issues, security vulnerabilities, and compatibility problems. Customers will be notified if their site contains outdated files. Continuing with unsupported or outdated systems may increase risk and reduce the effectiveness of support services. In such cases, rebuilding or updating the site is strongly recommended to maintain security, stability, and performance.Malware and Hacked Site Handling. If minor malware is detected on a site covered by a maintenance plan, it will be removed at no additional charge. For severe malware infections:Customers on the InMotion Care (Standard) plan will be advised to purchase the Hacked Site Repair service.Customers on the InMotion Care Pro plan will receive malware remediation as part of their coverage.In cases of major malware cleanup, the website may be temporarily non-operational during the restoration process.Service Levels.Custom Web Design: While Company strives to complete custom web designs within 4-6 weeks from the date of project initiation, completion times are estimates only and not guaranteed. Actual completion times may vary based on factors including, but not limited to, Customer responsiveness, revision requests, project complexity, technical requirements, e-commerce functionality, and other circumstances beyond Company’s control. Rush orders may be available for an additional fee at Company’s sole discretion.WordPress Rebuild: While Company may provide estimated project timelines based on Customer’s requests, all timelines are estimates only and not guaranteed. Actual completion times may vary based on various factors including, but not limited to, Customer responsiveness, project complexity, revisions, third-party dependencies, and other circumstances beyond Company’s control. Timelines can be impacted by requested revisions, third-party integrations, and specific requirements.QuickSite: The process typically takes up to two weeks, depending on how quickly content, feedback, and approvals are received from your side.Hacked Website Repair: While Company typically aims to address hacked websites within 2-3 business days, all timeframes are estimates only and not guaranteed. Actual completion times depend on various factors including, but not limited to, the nature and severity of the hack, availability of access to the website and relevant files, Customer responsiveness, and other circumstances. Priority service with targeted 24-hour turnaround may be available for an additional fee at Company’s sole discretion, subject to resource availability and technical feasibility.Website Optimization: Depending on the complexity, the timeframe to complete a website optimization ranges from a few days to several weeks.Search Engine Optimization (SEO): Customer acknowledges that SEO results are inherently uncertain and vary based on numerous factors beyond Company’s control, including but not limited to competition, industry conditions, website authority, search engine algorithms, and market changes. SEO is a long-term strategy and Company makes no guarantees or warranties regarding specific outcomes or rankings. While initial improvements may be observed within 4 to 6 weeks, and more significant changes within 3 to 6 months or longer, Company does not guarantee any particular timeline or results.Website Downtime and Related Technical Issues: Company is available to assist if a Customer’s website experiences downtime or other technical issues. Customers that maintain an active maintenance plan receive priority support. Company’s WordPress maintenance team uses commercially reasonable efforts to perform uptime monitoring and secure backups in accordance with the service level purchased by Customer. Monitoring and backup services are subject to the specific terms of Customer’s selected maintenance plan. While Company strives to diagnose and resolve issues promptly, response and resolution times are not guaranteed and may vary based on service level, complexity of issues, and other factors beyond Company’s control. If needed, a website rollback to a recent backup to minimize data loss and ensure stability may be available. Non-maintenance plan users may purchase support at an additional cost, if available, as outlined on Company’s Website.Data Preservation. In the event of a website restoration (e.g., Hacked Site Repair), while Company will use commercially reasonable efforts to preserve Customer’s data, Company makes no warranties or guarantees regarding data preservation or recovery. Customer acknowledges and assumes all risks associated with website restoration services, and agrees that Company shall not be liable for any damages, losses, or consequences arising from data loss or corruption during the restoration process. If available, Company will attempt to use the most recent backup for restoration, but Customer acknowledges that backup availability and integrity cannot be guaranteed. If a backup is not available, Company may, in its sole discretion, employ recovery techniques to attempt to retrieve data, provided however, these efforts do not guarantee any data will be available. Customer will be informed about compromised files, and presented with options to restore Customer’s website and enhance security.
