How Are Digital Millennium Copyright Act (DMCA) Complaints Handled?

I run a site that shares thousands of military related files for soldiers in the US Army for free. Recently I have had someone who downloaded a lot of my own content and is posting it for sale and in return filing DCMA takedown requests against my site. My current host refuses to validate the claims. For starters, documents created by government personal are considered public domain as they are part of their official duties. Secondly the accuser posts on his site that all his files were "donated" which clearly shows he doesn't own any copyrights to the content he is selling.

If I am to switch to your company for my hosting solutions I need to know if you will simply demand I remove content based off a random DCMA request, or if you will actually do the noble thing and validate that my site does not infringe on any copyrights.

What's inmotion's timeline for responding to DMCA notices? I've submitted one a week ago and nothing's been done yet. A site hosted on inmotion is stealing my content and hurting me bad. I'm started to go crazy just sitting around and waiting.
DMCA Process and address for your legal department.
I followed the instructions for DMCA takedown posted here.

https://www.inmotionhosting.com/pdf/copyright-claims-policy-dmca_rev0908.pdf

The overnight package with original documents and signatures that I sent to you was returned to sender. Do you have corrected instructions or address posted elsewhere? If so, I cannot find it.

It is very frustrated given that someone is already stealing my intellectual property to spend $25 sending a package to a dead address.

Hello, Thank you for contacting us about the correct address to send legal documents to. I definitely understand your frustration. You can mail this information to our West coast address listed on our contact page. Alternately, the Facsimile and email address listed on the PDF are accurate, and you can send them there. I have advised the correct department, so they can update the PDF as soon as possible. Thank you, John-Paul
