Titan Products Terms of Use / ServiceLast Updated: August 26, 2025Products. InMotion Hosting, Inc., its parent, subsidiaries, affiliates, and brands (collectively, “Company”) offer Customer Titan Mail and any other Titan products and services located on the Titan product(s) page (collectively, “Titan Products”).Titan Products Subject to Titan Terms of Use and Related Agreements:By signing up for the Titan Products, Customer agrees to abide by all of Titan’s terms of use/services related to Titan’s product(s) and services, including, without limitation, the Titan End User Terms of Use, Acceptable Use Policy, and other Titan Agreements and Policies (collectively, “Titan Agreements”).To the extent applicable, these Titan Mail Terms of Service (“Titan Mail ToS”) are subject to Company’s Universal Terms of Service (“UToS”), which are incorporated herein by this reference. Capitalized terms used and not otherwise defined herein shall have the meanings set forth in the UToS. In the event of a conflict between the Titan Agreements and the UToS, the Titan Agreements shall control.Titan shall bear sole, exclusive, primary, and first-line responsibility and liability for any and all claims, demands, actions, losses, damages, costs, expenses, penalties, fines, or other liabilities of any kind (including reasonable attorneys’ fees) arising from, relating to, or in connection with: (a) the access to, use of, provision of, or performance of any Titan Product; and/or (b) any act, omission, error, failure, or security incident (including without limitation, any breach of privacy, data security, or cybersecurity incident (including ransomware attacks, data breaches, unauthorized access, and system compromises)) involving any Customer Data (including without limitation name, email address, or other personally identifiable information) provided to, received by, processed by, transmitted by, stored by, or otherwise handled by Titan in connection with any Titan Product.Company shall have no obligation, duty, or liability whatsoever for any such matters unless Company is proven to be solely and directly at fault for any Customer claims, which must be documented by Customer and submitted to Company as determined in Company’s sole discretion. In no event shall Company’s aggregate liability exceed the liability cap listed in Section 19.2 of the UToS (as defined herein).Signup, Fees, and Auto-Renewal. To implement Titan Products, Customer must sign up and pay at the then-current product/service fee (“Titan Products Product Fee”) on the Website(s) or within the Customer Account (i.e., via AMP or other Customer Account access tools/software). Any Titan Products Product Fee will automatically renew upon expiration of the then-current term for a renewal period equal in time to the most recent service period at the then-current rates unless Customer opts out of auto-renewal through AMP.
